From the supplier: A National Association of Insurance Commissioners (NAIC) task force is reconsidering its initial assumption reinsurance draft law recommendation that permitted implied consent in the transferal of policies from one company to another. Sen Howard Metzenbaum has notified NAIC that denial of positive consent might conflict with policyholder rights and common law. Insurance companies favor the implied consent usage as more efficient and cost effective. NAIC is currently studying common law and possible variations on positive consent before making a final recommendation.
