Voluntary Bankruptcy Definition

This type of bankruptcy occurs when the debtor brings a petition to the court to declare bankruptcy because of the inability to pay off debts.  In this situation, the debtor chooses to declare bankruptcy before one or more creditors can petition the court.  The intention is to create a fair and orderly settlement of debts.
